What changes does the Mobility Package bring to international road transport?

 

The MOBILITY PACKAGE- in other words, is legislation aimed at regulating road transport for all European Union countries.

The first changes were introduced as early as 08.2020 and mainly covered driving and resting times for drivers staying within the European Union.  The deadline is fast approaching for the next phase to come into force, which directly affects road transport by cars up to 3.5 t.   

 

The Mobility Package introduces major changes in the international transport sector, and compliance with the new rules is bound to increase costs for transport companies. As a result (in accordance with the principles of the free market), it is very likely that entrepreneurs will increase the prices of services.

It is already known that the new directive will cover three levels of transport and the changes will concern:
  • pursuit of the occupation of transport operator and access to international markets
  • maximum daily and weekly driving times, minimum break times and daily and weekly rest periods and the rules on tachographs
  • the posting of drivers in the road transport sector and roadside checks

Upcoming changes

2 February 2022

 

  • At the beginning of the first stop after crossing the border of a Member State, the driver shall enter the symbol of the country into which he has entered. This stop shall take place at the nearest possible stopping place at or after the border,
  • Changes to the posting of drivers (i.e. compensation to the minimum salary) who carry out:
    - Cabotage transports,
    - Cross-trade / transfers (between two countries carried out by a carrier but not resident in either of them).
  • However, the following will not be subject to posting:
    - Transits (journeys through EU countries without loading/unloading operations),
    - Bilateral transports (international transport to and/or from the country of establishment of the company) with a maximum of two additional operations (loading/unloading).
  • Declarations on the posting of drivers must be made exclusively via IMI 
    (a system common to all EU countries),
  • Drivers subject to the new posting rules will be paid the full minimum salary payable in the country where they carry out their work,
  • From now on, it is not possible to count allowances and lump sums as part of a driver's minimum salary,
  • Companies that do not comply with the new rules may lose their good reputation (e.g. by carrying out unauthorised cabotage operations or failing to comply with posting obligations).

  • Once every eight weeks there will be an order for a lorry to drive down to its country of registration,
  • After three cabotage operations within a country, further cabotage operations will be suspended for four days,
  • Combined transport operations will be eligible for cabotage rules
    (on condition that the journey takes place within one EU country),
  • The obligation for Member States to impose penalties on consignors, freight forwarders, contractors and subcontractors for failure to comply with cabotage rules where they knew, or in the light of all relevant circumstances should have known, that the transport services they had contracted to carry out would involve infringements.

  • The obligation to have a Community licence for international road transport for vehicles from 2.5 t.,
  • The requirement for a financial security of €1,800 for the first vehicle and €900 for each additional vehicle.
  • Companies using vehicles from 2.5 t., will be obliged to register their place of business,
  • Carriers of vehicles from 2.5 t. and over will be subject to the provisions of common rules (licence and cabotage),
